Nintendo obtains IA Labs patent portfolio after court win

Nintendo of America have confirmed that they have obtained the entire patent portfolio of IA Labs after a sheriff’s sale in Montgomery County, Maryland.

IA Labs had sued Nintendo in April 2010 claiming that the Wii Fit Balance Board infringed upon their patent, although they successfully defended the lawsuit and obtained judgment in their in February 2012. Nintendo were awarded some of the costs and fees incurred through defending the case, although IA Labs appealed the ruling.

The appeals court upheld Nintendo’s win in June 2013, ordering IA Labs to pay Nintendo for additional costs although this wasn’t paid leading to the sheriff’s sale to sell their remaining assets – the patent portfolio becoming partial repayment for litigation costs.

“Nintendo’s track record demonstrates that we vigorously defend patent lawsuits, like the IA Labs lawsuit, when we believe we have not infringed another party’s patent. This includes holding those who sue Nintendo responsible for the costs and expenses incurred in patent litigation,” commented Richard Medway, Nintendo of America’s vice president and deputy general counsel. “Nintendo has a long history of developing innovative products while respecting the intellectual property rights of others.”
