Tomita Technologies have sued Nintendo for infringing upon a patent that was filed in 2003 and issued to them within 2008.

Patent 7417664 is in regards to the design of a “stereoscopic image picking up and display system based upon optical axes cross-point information.” Such similarities are indeed directly comparable to the Nintendo 3DS, the glasses-free stereoscopic 3D being a key feature of their latest handheld.

“Nintendo of America’s infringement of the ‘664 patent has been, and continues to be, willful,” Tomita allege within the complaint, although does not continue to detail the exact nature of the infringement stating that the damage caused is “in an amount not yet determined.”

Tomita Technologies are seeking a trial by jury, in which the decision will be made by the court.
